Terms of Service
1. The service
HailGuard is a real-time hail monitoring platform for Europe. It aggregates weather radar data, official meteorological bulletins, news reports and user-submitted media to display hail activity on a map and to send alerts (push notifications and email) for areas you monitor. By creating an account or using the service you accept these Terms.
2. Nature of the alerts — important
All HailGuard alerts are probabilistic. Radar signatures and weather bulletins indicate the likelihood of hail, not certainty; events labelled as detected or reported are not confirmed on the ground unless explicitly marked as verified. HailGuard is not a substitute for official civil-protection or national weather-service warnings, and must not be relied upon as the sole basis for decisions involving safety of persons or protection of property. Coverage, timeliness and accuracy depend on third-party data sources and delivery networks (radar providers, meteorological services, push and email infrastructure) that are outside our control: we do not guarantee that every hail event will be detected or that every alert will be delivered, or delivered in time.
3. Your account
You must provide a valid email address and are responsible for the activity on your account. The location(s) you set determine which alerts you receive; keeping them accurate is your responsibility. Alert delivery also requires that you grant the relevant permissions on your device (notification permission for push; a valid, reachable inbox for email).
4. Free and paid plans
The base service is free. Paid plans extend the monitoring radius and features as described on the pricing page at the time of purchase. Payments are processed by Stripe; we never store your card details.
Paid subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time from your profile ("Manage subscription"), with effect from the end of the current paid period; you keep access until then. No refunds are due for partial periods, without prejudice to your statutory rights.
5. Right of withdrawal (EU consumers)
EU consumers normally have a 14-day right of withdrawal for distance contracts. HailGuard is a digital service activated immediately upon purchase: at checkout you are asked to expressly consent to immediate activation and acknowledge that you thereby lose the right of withdrawal, as permitted by EU consumer law. Your consent is recorded. If you did not give that consent, you may withdraw within 14 days of purchase by writing to the contact address below and you will be refunded.
6. Acceptable use
You may not scrape, resell or systematically redistribute the data, alerts or content provided by the service; abuse the API or attempt to circumvent plan limits; or use the service in any unlawful way. We may suspend accounts that violate these rules.
7. Data sources and attribution
Maps, radar imagery, weather bulletins and place names come from third-party sources (including national meteorological services, MeteoAlarm, RainViewer, Open-Meteo, Mapbox and GeoNames) under their respective licences. Their availability is not guaranteed by HailGuard. User-submitted photos remain the property of their authors.
8. Limitation of liability
To the maximum extent permitted by law, HailGuard shall not be liable for damages arising from missed, delayed or inaccurate alerts, from service interruptions, or from decisions taken on the basis of the information provided (see Section 2). For paid plans, our aggregate liability is limited to the amounts you paid for the service in the 12 months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded by law, including mandatory consumer protections in your country of residence.
9. Changes to the service or Terms
We may modify the service and these Terms. For material changes affecting paid subscribers we will give notice by email at least 30 days in advance; if you disagree, you may cancel before the change takes effect. Continued use after the effective date constitutes acceptance.
10. Governing law
These Terms are governed by Italian law. If you are a consumer, you also benefit from the mandatory protections of the law of your country of residence, and disputes may be brought before the courts of that country. EU consumers can also use the European Online Dispute Resolution platform.
